By engaging Kilchsperger Media Service for digital marketing operations, you enter into a binding professional agreement outlined by these Terms of Service. These parameters dictate the execution of all marketing retainers, strategic consultations, and digital deployments.
Kilchsperger Media Service engineers advanced digital marketing matrices, which may include Technical SEO, Algorithmic Media Buying, Conversion Interface Design, and Pipeline Automation. The exact deployment scopes, sprint structures, and key deliverables will be strictly codified in a customized Statement of Work (SOW).
Because digital ecosystems (such as Google’s indexing algorithm or Meta’s ad auction) are highly fluid, Kilchsperger Media Service explicitly notes that execution timelines and ranking projections are estimations. Kilchsperger Media Service cannot be held responsible for performance fluctuations driven by unannounced algorithmic updates initiated by third-party tech entities.
Agency management retainers are entirely independent of advertising capital. The client is wholly responsible for funding media spend directly through the relevant platforms (e.g., Google Ads). Should an advertising account deactivate due to client billing failures, Kilchsperger Media Service assumes no liability for the resulting degradation in lead velocity.
Operational success requires the transmission of highly sensitive data. Kilchsperger Media Service and the client mutually commit to maintaining absolute confidentiality regarding strategic frameworks, internal financial metrics, and proprietary software disclosed throughout the engagement.
Service retainers may be deactivated under the terms outlined in the master agreement. Upon successful conclusion, and provided all financial accounts are settled, Kilchsperger Media Service will immediately transfer administrative rights of all tracking portals, ad networks, and developed assets to the client.
These terms shall be governed by the laws operating in the jurisdiction of Kilchsperger Media Service. Any technical or financial disputes relating to marketing executions will be handled via arbitration frameworks established by Kilchsperger Media Service.
